These Terms and Conditions (the "Terms") govern access to and use of the Star Gallery Mart website (www.stargallery.ae), mobile application, retail stores, social-media sales channels, and other UAE sales channels operated by Star Gallery Mart (the "Company," "we," "our," or "us"). They also govern orders and purchases made through those channels.

By accessing a digital channel, creating an account, placing an order, paying for a product, or completing an in-store purchase, the customer (the "Customer," "you," or "your") agrees to these Terms. If you do not agree, do not use our digital channels or place an order.

These Terms apply to customers and deliveries within the United Arab Emirates only. Separate terms may apply to international orders.

Nothing in these Terms excludes or limits any consumer right, supplier obligation, remedy, warranty, disclosure requirement, or liability that cannot lawfully be excluded or limited under applicable UAE law. A mandatory legal requirement prevails over any conflicting provision.

2. Customer Eligibility and Authority

You must have legal capacity to enter into a binding transaction. If you order for a company or another person, you confirm that you are authorised to bind them. Products subject to age, identity, licensing, export, telecommunications, or other legal restrictions may require verification and may not be sold where the legal requirements are not met.

3. Accounts and Customer Information

You must provide complete, accurate, and current information, protect your account credentials, and promptly notify us of suspected unauthorised use. You are responsible for activity conducted through your account unless applicable law provides otherwise.
  • We may request identity, payment, delivery, fraud-prevention, or eligibility verification before accepting or dispatching an order.
  • We may suspend or close an account that is false, compromised, abusive, fraudulent, or used in breach of these Terms.
  • You must not create multiple accounts to misuse promotions, limits, refunds, loyalty benefits, or platform functions.

4. Product Information and Availability

We aim to describe products accurately. Images, colours, packaging, dimensions, and screen displays may vary slightly from the actual product. Technical specifications and compatibility should be checked before purchase.

Availability is not guaranteed until an order is accepted. Stock information may change, including where an item is damaged, reserved, discontinued, incorrectly counted, or unavailable from a supplier. We may set reasonable purchase limits.

5. Prices, VAT, and Errors

Prices are displayed in UAE dirhams and include or exclude VAT as stated at the point of sale. Delivery, installation, service, payment-provider, or other disclosed charges may be added before order confirmation.

If a price, description, promotion, stock status, discount, or calculation contains a clear error, we may correct it before accepting the order. If an accepted order is affected by a material error, we will contact you and, where lawful, offer the correct terms or cancel and refund the affected amount.

6. Orders and Contract Formation

Submitting an order is an offer to purchase. An automated acknowledgement confirms receipt only and does not necessarily mean acceptance. A binding sale is formed when we expressly accept the order, issue a final sales confirmation, dispatch the product, or complete the sale in-store, whichever occurs first.

We may reject or cancel an order before acceptance for legitimate reasons, including unavailability, payment failure, suspected fraud, pricing or listing error, legal restriction, delivery limitation, purchase-limit abuse, or inability to verify information. If payment was captured for a cancelled order, the refundable amount will be returned using the applicable process.

7. Payment

You must pay the full amount using an accepted payment method. Payment options may include cash, credit or debit cards, Apple Pay, Tabby, Tamara, or other methods displayed at checkout. Availability and provider approval may vary.

You authorise us and our payment providers to process the transaction and relevant verification. Instalment or buy-now-pay-later services are also governed by the provider's terms. We are not responsible for a provider's independent credit or eligibility decision.

  • The order may be held until payment is successfully confirmed.
  • You must use a payment method that you are authorised to use.
  • Refund timing may depend on banks and payment providers after we process the refund.

8. Promotions, Vouchers, and Gift Cards

Promotions apply only during the stated period and subject to their specific conditions, stock availability, customer or product limits, and channel restrictions. Unless expressly permitted, offers cannot be combined, exchanged for cash, transferred, or applied retrospectively.
  • We may refuse or reverse a benefit obtained through error, manipulation, duplicate accounts, automated activity, or abuse.
  • Gift cards, store credit, and promotional codes are subject to any terms disclosed when issued and to applicable law.
  • If an order is returned or cancelled, promotional value may be recalculated and non-cash benefits may be withdrawn.

9. Delivery and Collection

Delivery estimates are not guaranteed unless expressly stated. You must provide an accurate address and valid contact details, ensure lawful and safe access, and arrange for an authorised person to receive the order.
  • We may require identification, an order code, signature, or other proof at delivery or collection.
  • Additional charges may apply for re-delivery, remote areas, special handling, failed access, incorrect information, or other circumstances disclosed before the service is provided.
  • You must inspect the order promptly and report damaged packaging, damaged products, missing items, or incorrect products within the period stated in our Return, Refund & Exchange Policy.

10. Risk, Title, and Inspection

Risk in a product passes to you upon delivery to you or your authorised recipient, except to the extent applicable law provides otherwise. Ownership passes after full cleared payment and delivery. This does not affect mandatory consumer rights.

We may record serial numbers, IMEI numbers, barcodes, seals, and security identifiers before dispatch and verify them when processing a return, warranty claim, exchange, or fraud investigation.

11. Cancellations, Returns, Refunds, and Exchanges

Cancellations, returns, refunds, exchanges, non-returnable products, inspections, restocking fees, non-refundable charges, and refund cancellation fees are governed by our Return, Refund & Exchange Policy in force at the time of purchase, as disclosed through the relevant sales channel.

That policy forms part of these Terms. If it conflicts with a mandatory UAE consumer right, the mandatory right prevails.

12. Service and Warranty

Warranty availability and duration depend on the specific product and may be 12 months, 2 years, 3 years, or no commercial warranty, as disclosed before purchase. Warranty claims and exclusions are governed by our Service & Warranty Policy and the product-specific warranty information.

A commercial service warranty does not exclude mandatory remedies under UAE law. Customers must retain proof of purchase and follow data-backup, device-lock, accessory, inspection, and delivery instructions in the applicable policy.

13. Customer Data and Privacy

We process personal data for orders, payments, delivery, support, fraud prevention, legal compliance, marketing choices, platform operation, and related legitimate business purposes in accordance with applicable UAE data-protection law and our Privacy Policy.

You must not submit another person's data without authority. Digital channels may use cookies or similar technologies as explained in the applicable notice. Payment providers, delivery companies, manufacturers, authorised service centres, and technology providers may process data needed to perform their services, subject to applicable law.

14. Electronic Communications and Records

You agree that orders, confirmations, invoices, notices, approvals, policies, and other records may be provided electronically through the website, app, email, SMS, messaging services, or social-media channel used for the transaction, where legally permitted. Electronic records, authentication methods, and signatures may be used to evidence transactions in accordance with applicable UAE law.

15. Acceptable Use

You must not misuse our website, app, social-media channels, stores, staff, systems, or services. Prohibited conduct includes:
  • Fraud, impersonation, false claims, chargeback abuse, or unauthorised payment activity.
  • Uploading malware, scraping, automated purchasing, interference, security testing without permission, or attempts to access restricted systems or data.
  • Harassment, threats, unlawful, defamatory, obscene, or infringing content.

16. Intellectual Property

The Star Gallery Mart name, branding, website, app, designs, text, graphics, photographs, videos, software, databases, and other content are owned by us or used under licence and are protected by applicable intellectual-property laws. You receive a limited, revocable, non-transferable right to use our digital channels for personal shopping. No ownership or broader licence is granted.

17. Reviews and Customer Content

If you submit a review, image, message, or other content, you confirm that it is accurate, lawful, non-confidential, and does not infringe another person's rights. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, moderate, format, and display that content for operating and promoting our services, subject to applicable privacy law.

We may remove content that is unlawful, misleading, abusive, irrelevant, infringing, or otherwise breaches these Terms, but we are not required to publish or continuously monitor customer content.

18. Third-Party Services and Links

Our channels may link to or integrate third-party payment, instalment, delivery, mapping, social-media, manufacturer, or other services. Those services may have separate terms and privacy notices. We are not responsible for an independent third party's platform, decision, availability, or content, except where responsibility cannot lawfully be excluded.

19. Product Use, Compatibility, and Safety

You must follow manufacturer instructions, warnings, installation requirements, voltage and compatibility specifications, age restrictions, and applicable laws. Do not use a damaged, recalled, unsafe, incorrectly supplied, or suspected counterfeit product; stop use and contact us promptly.

Professional installation may be required for certain products. Customer-caused damage, unauthorised modification, incorrect voltage, misuse, or incompatible accessories may affect commercial warranty coverage, subject always to mandatory law.

20. Disclaimer and Limitation of Liability

We provide our digital channels on an as-available basis and do not guarantee uninterrupted or error-free access. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss, loss of profit, loss of opportunity, or data loss arising from use of the channels or products.

Nothing limits liability that cannot legally be limited, including mandatory consumer remedies or liability arising from fraud, wilful misconduct, or any other matter for which exclusion is prohibited. Where liability may lawfully be limited, our aggregate liability relating to a purchase will not exceed the amount paid for the affected product or service.

21. Customer Responsibility and Indemnity

You are responsible for loss caused by your unlawful use, fraud, wilful misconduct, or material breach of these Terms. To the extent permitted by law, you agree to reimburse us for reasonable losses, claims, and costs resulting directly from such conduct. This clause does not apply to ordinary consumer use or reduce any mandatory consumer right.

22. Events Beyond Reasonable Control

We are not responsible for delay or failure caused by events beyond our reasonable control, including severe weather, transport disruption, system or telecommunications failure, cyberattack, epidemic, government action, import restriction, supplier interruption, labour disruption, or force majeure. We will take reasonable steps to reduce the effect and perform when reasonably possible. Mandatory legal rights remain unaffected.

23. Suspension and Termination

We may suspend access, hold an order, restrict a payment method, refuse service, or terminate an account where reasonably necessary for security, fraud prevention, legal compliance, safety, system protection, abusive conduct, or a material breach. We will not use this clause to avoid an accepted obligation or mandatory consumer remedy.

Changes apply prospectively unless lawfully stated otherwise. Terms applicable to an accepted order generally remain those in force when the order was accepted, except for mandatory legal changes.

25. Governing Law and Disputes

These Terms and UAE transactions are governed by the laws of the United Arab Emirates and the applicable laws of the Emirate in which the relevant Star Gallery Mart establishment or transaction is located, without limiting mandatory consumer protections.

Please contact Customer Service first so we can try to resolve a complaint. Nothing prevents a consumer from contacting the competent UAE consumer-protection authority or bringing a claim before a court or other body having mandatory jurisdiction.

26. General Provisions

  • Severability: If a provision is invalid or unenforceable, the remaining provisions continue to apply, and the affected provision is limited to the minimum extent necessary.
